Court updates: Hiawatha Teacher sentenced
A former Hiawatha teacher has been sentenced for having unlawful sexual relations with an underage student while she was teaching at Hiawatha High School during the 2016-17 school year.
Gabrielle Bauman, 24, of Fairview appeared in court Monday, Jan. 22, and was handed her sentence for the charge of unlawful sexual relations. Bauman pleaded no contest in November 2017 to the charge, which is a level 5-person felony.
According to Brown County Attorney Kevin Hill, Bauman was a border box on the Kansas sentencing guidelines.
“She was a border box on the Kansas sentencing guidelines since the offense is a level 5 and she had no prior record,” Hill said. “With a border box, the judge can sentence to a probation sentence if there is a suitable treatment program available.”
“The defense presented a psycho-sexual evaluation from a psychiatrist that identified mental health issues that she is receiving treatment for,” Hill said. “With that, the defense referencing the loss of her teaching license as a result of her conviction; and the victim and victim’s family asking for probation [the State did not join in their request for probation].”
Hill said with that information, the judge placed her on probation for 36 months on an underlying 32 month sentence. Bauman is required to register as a sex offender for 25 years.
Bauman was arrested on Tuesday, Aug. 29, 2017, by the Hiawatha Police Department (HPD) following an investigation, which included the execution of a search warrant and forensic review of several electronic devices by the HPD Digital Forensics Unit and the Heart of America Regional Computer Forensic Lab in Kansas City.
The criminal complaint said that Bauman unlawfully engaged in consensual sexual intercourse or lewd fondling or touching of a student born in 1999, from November 2016 through May 21, 2017, during which time Bauman was employed as a science teacher at Hiawatha High School.
The USD No. 415 Board of Education accepted Bauman’s resignation during their July 10, 2017 meeting. She had taught at Hiawatha High School for one year.
Bauman is a 2012 graduate of Sabetha High School.
