Oscar Martinez’s arraignment continued
The third person allegedly involved in a Hiawatha home invasion in May 2017 has had his arraignment continued.
Oscar Martinez, 28, of Bern was scheduled to be arraigned at 9:30 a.m. Monday, June 11, but instead has had his arraignment continued until 9 a.m. Monday, July 9.
Martinez was arrested in February 2018 by the Brown County Sheriff’s Department after extraditing him from jail in Nebraska, where he was being held on separate charges. Hill said his office had to go through a lengthy process in order to bring him back to Kansas.
O. Martinez is being held on felony charges of aggravated robbery, aggravated burglary and aggravated battery along with a misdemeanor count of criminal restraint, which stem from a home invasion in Hiawatha on May 16, 2017.
It is alleged that O. Martinez – along with co-defendants Edgar Martinez and Hicks, both of Sabetha – broke into the home of Ray Atlakson, 30, where Atlakson reported he was battered and robbed, with his hands tied behind his back before the suspects fled the scene.
Atlakson was taken to the Hiawatha Community Hospital by ambulance for the treatment of his injuries.
Items taken from the scene included a pair of car keys, billfold and an RCA tablet.
O. Martinez is being held in the Brown County Jail on a $100,000 bond.
E. Martinez and Hicks were arrested for their involvement in the crime on May 19, 2017. In November 2017, they both received their sentences — 56 months in prison for E. Martinez and 36 months supervised probation for Hicks.
Hicks was arrested on Wednesday, Feb. 28, after it was found that she violated the terms of her probation. She has been sentenced to 120 days in prison.
